Is a Sock a Gateway Drug? Mellouli v. Holder and the Categorical Approach in Crimmigration Cases.
Mellouli is a case currently pending before the Supreme Court in which the Court must decide if the government was correct in deporting Mr. Mellouli for possession of drug paraphernalia (his sock). The case raises interesting issues regarding how the “categorical approach” in “crimmigration” cases (cases involving immigration consequences arising from criminal proceedings) should be applied.
