In May Eric Berger presented a new paper “The World According to the Court” at the Law and Society Annual Conference in Minneapolis, MN. The paper was presented as part of a panel about “Inequality in the Eyes of the Court.” It explores Supreme Court fact-finding in recent constitutional decisions. Specifically, the paper argues that the Supreme Court aggressively finds facts to support the normative outcome it favors in a variety of constitutional contexts.
